Who should have the authority to approve large town fee discounts?
ON THE AGENDA - After finding out that certain developers have been charged way below market value for water sewer connection fees I asked that a discussion on the discount process be added to our June work session agenda. My request was "Consideration of amendments to the Town Code of Ordinances regarding authority to grant individual and business fee discounts". Town staff took the liberty to put a long write up in the agenda packet defending their opinion on how 6 figure discounts are within the town managers authority (See Town Attorney's Memo below). Even though I asked for the agenda item I had no input on what was stated in the memo. I have never argued that the town manage doesn't have the authority to determine the number and type of connections, I just don't agree that negates Sec 21-73 or 21-81 developers paying connection fees for each unit.
The memo in the agenda packet is attached to my request it is the town attorney's legal opinion and he works for the town (not you or me). I'm glad the town attorney provided where he believes the town managers authority comes from but my point is

I want to discuss council amending town code to limit the powers (perceived or real) to grant discounts in the future so no one person has the ability to make such deals. I'm certain at least one council member will try to say this is an attack on staff and we need to trust them. I'm sorry but that argument doesn't hold water. Discounts cost everyone in their monthly bills so I believe Council should vote publicly on any such discounts.
